Overview Of The Settlement
Important Update: On February 28, 2014, the Court issued an Order Granting Motion for Final Approval of Class Action Settlement Agreement, and Motion for Attorneys' Fees, Expenses and Incentive Awards, which can be viewed under Court Documents.
If You Paid for or Received Insurance from AvMed, Inc. at Any Time Through December of 2009, You May Be Part of a Class Action Settlement.
A settlement has been proposed in a class action lawsuit regarding claims that in December of 2009, unsecured laptops containing the Sensitive Personal Information of AvMed customers were stolen while they were in the Defendant's custody. The Court conditionally certified two Classes for settlement purposes, so that the members of such Classes could be given notice and the opportunity to exclude themselves if they wished, voiced their support or opposition to the Settlement, and also to explain how those who did not exclude themselves may have submitted a Claim Form to get the monetary benefit offered by the Settlement.

Final Approval Hearing
The Court held the Fairness Hearing at 10:30 a.m. on February 28, 2014, in Courtroom 1127 of the James Lawrence King Federal Justice Building, 99 Northeast Fourth Street, Miami, Florida 33132. At the hearing the Court determined that the Settlement was fair, reasonable, adequate, and in the best interests of the Classes. The Court also approved a fee and expense award for Class Counsel and incentive awards for the Class Representatives.
